Ingoldisthorpe driver loses licence over failure to provide breath test




A woman who said she was too anxious to provide a breath test has lost her driving licence for 24 months as a result.

Emily Howe, 46, of Lynn Road, Ingoldisthorpe, pleaded guilty to failing to provide a specimen at Lynn police station on August 19, when she appeared before Lynn magistrates on Thursday.

Asif Akram said Howe’s Vauxhall Marina car was stopped by police because of concerns about how it was being driven.

She was asked to provide a roadside breath test which she did and it showed a reading of 100mcg of alcohol in 100ml of breath – the legal limit is 35mcg.

Mr Akram said Howe was arrested and taken to the police station where she was asked to provide a further test multiple times, but despite being warned she was facing prosecution if she did not do it, she failed to provide a specimen.

Howe, who appeared unrepresented, told magistrates what had been said by the prosecutor was correct.

But she said: “I was very, very anxious and upset and it affected me being able to give a sample.

“I’m very sorry, and that is all I can say about the matter,” she said.

Magistrates disqualified her for 24 months but said she could do the driver’s rehabilitation course, which would reduce the ban by 24 weeks.

They also fined her £300 with £85 costs and £120 victim surcharge.
