Driver refused breath test after A148 crash, King's Lynn court told
A woman who crashed off a main road near Lynn refused to take a breath test, a court has heard.
Police had been told about a vehicle being driven erratically and weaving over the A148 late at night.
Officers were then told that it had come off the road and crashed into a hedge.
When they arrived on scene, 29-year-old Jade Marsden was standing by the driver’s door holding the keys.
Her speech was slurred and she was unsteady on her feet, prosecutor Kate Draper told Lynn Magistrates’ Court on Thursday.
“An officer asked her to provide a specimen of breath but she refused. When pressed on why she told him to shut up.
“He asked if there were medical reasons why she couldn’t give a sample. She replied ‘yeah, loads’”.
Marsden, of Bagthorpe Road, East Rudham, pleaded guilty to failing to provide a specimen for analysis.
She had no previous convictions and her solicitor Ruth Johnson said she was shocked to hear that she had got into trouble.
Miss Johnson outlined some family issues and said Marsden was in need of the support that she herself had been offering for so long.
“I’m confident that she’s someone you are not going to see again,” Miss Johnson told the bench.
Marsden was disqualified from driving for 17 months, which can be cut with completion of a drink-driver rehabilitation course.
She was also given a 12-month community order with requirements of up to 30 rehabilitation activity requirement days and attendance on the WONDER+ support service for female offenders.
She was also ordered to pay a £95 victim surcharge.
